Terms and Conditions (T&C)
Fahrdienst Schönberger GmbH
1. Prices
The prices listed in the currently valid price list apply.
We reserve the right to correct any errors in cost estimates or calculations. Flat-rate quotes are valid only for a limited time and for a specific order.
By entering into the contract, customers accept the terms and conditions of Fahrdienst Schönberger GmbH.
2. Orders
Orders are generally carried out in the manner in which they are placed by telephone, in writing, or by fax and confirmed in writing. The written order confirmation from Fahrdienst Schönberger GmbH is the sole basis for the acceptance of the contract (the scope of the services owed under the contract). The customer agrees to carefully review the contents of the order confirmation.
Orders of any kind must clearly identify the subject matter of the transaction. Amendments, confirmations, or duplicates must be identified as such.
Verbal agreements must be confirmed in writing or by other written means.
The terms and conditions of Fahrdienst Schönberger GmbH apply to this contract.
3. Rates
Schönberger GmbH Transportation Services offers its customers the following rates:
Shared Ride: In a shared ride, multiple passengers are picked up one after another from their pickup addresses and driven together to their desired destination. To make a shared ride possible, passengers are picked up earlier, and flexibility regarding timing is required. We cannot accommodate customers’ preferred pickup times in order to facilitate a shared ride. Upon arrival at the airport, the customer may have to wait for their driver or other passengers. However, this wait time must not exceed 90 minutes. The passenger will be dropped off after the other passengers have been dropped off.
Direct Ride: The direct-ride passenger is picked up at their pickup address at the requested time and driven directly to their destination without any detours. It is possible that another passenger will be picked up before the direct-ride passenger and will already be in the car. However, this passenger will not be dropped off at their destination until after the direct-ride passenger has been dropped off. Upon arrival at the airport, the customer may have to wait a short time—up to 15 minutes—for their driver before heading to the destination.
One-Way Trip: For a one-way trip, the passenger is picked up at their pickup address at the requested time and driven directly to their destination without any detours or stops along the way. For a one-way trip, the car is reserved exclusively for the customer. No other passengers—such as fellow travelers—may be transported with the single-ride passenger.
Bus Ride: During a bus ride, passengers are picked up from their pickup address at their requested time and driven to their destination without any stops or detours. After consulting with and obtaining permission from the passengers on the bus ride, additional passengers may be transported.
VIP Ride: A VIP ride is similar to a private or bus ride, with the difference that the passenger is transported in a higher-end vehicle, such as a Mercedes E-Class or Mercedes V-Class.
Private Trip: The term “private trip” refers to all types of transfers not listed among the fare types explained above. These include not only staff trips, courier trips, and eco-transfers, but also medical transport and similar services. It is also possible to rent vehicles with a driver. This type of service is arranged on an individual basis, according to the customer’s preferences.
4. Special Features of the Shuttle Service
Fahrdienst Schönberger GmbH will confirm a customer’s booking via email, including the booking details such as the pickup date, location, and time. The pickup time must be adhered to as scheduled and depending on the situation; otherwise, the right to transportation generally lapses (after a maximum of 15 minutes
of waiting time by the Fahrdienst Schönberger GmbH driver) and may be billed to the customer as so-called “waiting time.”
The customer must be reachable by phone during the pickup window (45 minutes before or after the agreed-upon time); otherwise, a timely pickup may not be guaranteed under certain circumstances. The pickup is considered timely if it takes place within the pickup window. If a Fahrdienst Schönberger GmbH driver does not arrive within the agreed-upon pickup window, the customer must notify Fahrdienst Schönberger GmbH—preferably by phone, but other methods are also acceptable.
When using the Fahrdienst Schönberger GmbH Airport Shuttle Service, customers are generally picked up at the airport from the respective meeting point in the terminal. The customer is responsible for locating the Fahrdienst Schönberger GmbH driver waiting at the meeting point, who will be identified by a name tag or the Fahrdienst Schönberger GmbH company logo. Alternatively, pickup is available at the Fahrdienst Schönberger GmbH counter.
In the event of changes to flight or landing times, Fahrdienst Schönberger GmbH will make every effort to arrive on time. Fahrdienst Schönberger GmbH is not aware of any flight delays. Monitoring flight departures and arrivals, checking for delays, or verifying whether flights are taking place at all is not part of Fahrdienst Schönberger GmbH’s responsibilities. Fahrdienst Schönberger GmbH assumes no responsibility for any resulting wait times experienced by passengers.
For ride requests made on short notice, Fahrdienst Schönberger GmbH reserves the right to charge an additional express fee. Same-day ride requests are defined as follows: requests made on the same day and bookings made after 3:00 p.m. for the following day. This fee may also apply to last-minute rescheduling or changes.
We assume no liability for legal claims arising from delays beyond our control. For passengers, this means that we are responsible for determining the pickup time. We transport customers so that they generally arrive at the airport 2 hours before departure.
5. Waiting time
The free waiting time for return trips at airports is 60 minutes (arrival time as stated in the order confirmation). After that, a waiting fee will be charged. The waiting fee is calculated in quarter-hour increments and may be charged for every 15 minutes or portion thereof.
Customers may have to wait if a flight arrives at the airport early or late.
If there are already subsequent orders pending, they will be given priority, and waiting times within reasonable limits cannot be ruled out afterward. A change to the booked rate—with the price remaining the same—cannot be ruled out.
If a passenger changes the appointment without consulting us, they are not entitled to transportation, a refund, or a discount. In the event of booking errors on the part of Fahrdienst Schönberger GmbH, the customer is obligated to notify Fahrdienst Schönberger GmbH of such errors in a timely manner. The date specified at the time of booking is decisive.
6. Fare / Fee for Services Rendered
If payment in cash has been agreed upon, the fare must be paid to the Fahrdienst Schönberger GmbH driver no later than the end of the trip. If the trip is a round trip, the full fare must be paid to the Fahrdienst Schönberger GmbH driver upon completion of the first leg of the trip.
If invoicing has been agreed upon, payment is due in accordance with the specified payment terms. The invoice amount must be transferred to the designated account of Fahrdienst Schönberger GmbH within 14 days, citing the invoice number and customer number.
If orders are carried out on behalf of a third party, the client is responsible for paying the corresponding fee in case of doubt.
In the event of late payment, interest on late payments will be charged in accordance with statutory provisions (§ 288 BGB). If a collection agency is engaged due to late payment, the customer shall bear all resulting costs in full.
7. Luggage
Each passenger may bring a maximum of one piece of checked luggage plus one standard-sized carry-on bag.
Additional pieces of luggage or bulky items must be declared when placing the ride request; otherwise, there is no entitlement to transportation for these items. Fahre Dienst Schönberger GmbH may charge additional fees for such items. The amount of the additional fees will be provided upon request.
Pets may only be brought on board when booking a one-way trip. They must be transported in the crates required by law.
8. Cancellation / Cancellation Fees
The contracting parties have the right to cancel the transportation order. Cancellations must be made in writing.
Cancellation of an airport shuttle service is free of charge only up to 12 hours before the scheduled departure time at
. If the customer fails to show up for a ride (a so-called “no-show”) or cancels the ride request within the specified time frame, Fahrdienst Schönberger GmbH reserves the right to charge the customer the full amount of the order or the full fare.
Individual cancellation policies remain unaffected by this.
Changes to a booking are free of charge if Fahrdienst Schönberger GmbH receives the necessary information at least 6 hours before the start of the trip and the change is in accordance with the cancellation policy. Up to two changes are free of charge; starting with the third change, a processing fee will be charged for each additional change.
In the event that the normal course of service is disrupted due to force majeure (weather, traffic, vehicle breakdown), no claim for compensation may be made against us. In the event of a vehicle breakdown, we will attempt to transport passengers further at our expense.
9. Prohibited Uses
Vehicles operated by Fahrdienst Schönberger GmbH may not be used
a) for the transport of hazardous or illegal substances of any kind.
b) to commit criminal offenses as defined in the German Criminal Code (§§ 1–9 StGB), even if such offenses are punishable only under the law of the place where the offense was committed.
c) for trips that go beyond the contractual use.
The customer is prohibited from instructing the drivers of Fahrdienst Schönberger GmbH to engage in the activities listed in sections a) through c).
10. Customer Liability
a) The customer is personally and unlimitedly liable to Fahrdienst Schönberger GmbH for any damage to the vehicle caused by the customer through fault, i.e., intentionally or through negligence.
b) Furthermore, the customer is personally and fully liable for all damages resulting from use for prohibited purposes.
(c) The statutory liability provisions remain unaffected.
The customer shall bear any damages resulting from transmission errors, misunderstandings, or mistakes in telephone, written, or email communications with the customer or with third parties, provided that such damages were not caused by Fahrdienst Schönberger GmbH.
Fahrdienst Schönberger GmbH reserves the right to request confirmation of orders received by telephone, in writing (including by mail), or via email for security reasons.
If communications made by phone, in writing, or via email are confirmed in writing, the customer must immediately report any discrepancies between these communications and the written confirmation.
11. Liability of Flughafentransfer Schönberger GmbH
Fahrdienst Schönberger GmbH is liable for all damages caused to the customer through fault—that is, intentionally or negligently—to the extent that such damages are covered under the motor vehicle liability insurance policy taken out for the respective passenger car.
In the event of a delay, liability applies only in cases of gross negligence or willful misconduct. Fahrdienst Schönberger GmbH may, in its own name, entrust third parties with the performance of all tasks assigned to it, in whole or in part, if it deems this justified after weighing the customer’s interests.
If Fahrdienst Schönberger GmbH makes use of this option, its liability is limited to the careful selection and training of the third party it engages.
We assume no liability for delays caused by heavy traffic, traffic jams, force majeure, or unforeseeable vehicle breakdowns. Fahrdienst Schönberger GmbH is also not liable for theft of luggage by third parties.
12. Claims for Damages
Claims for damages against Fahrdienst Schönberger GmbH become due only when they are free of defenses and objections regarding the merits of the claim and the corresponding amount claimed. If claims for damages result from a traffic accident, a claim exists only if the claimant has previously had the opportunity to review the investigation file. The amount of such claims is determined by the insurance coverage.
For all other claims asserted against Fahrdienst Schönberger GmbH, Fahrdienst Schönberger GmbH will pay only on the basis of invoices that comply with general legal requirements.
Liability for indirect claims for damages is limited to eight times the net fare.
13. Right to Make Changes
As a general rule, the vehicle ordered in accordance with the request will be provided. If, for internal company reasons or due to objective impossibility, it is not possible to fulfill the request, Fahrdienst Schönberger GmbH reserves the right to provide a different vehicle. In doing so, Fahrdienst Schönberger GmbH will endeavor to minimize any deviation from the ordered vehicle as much as possible, taking into account the vehicle’s customary purpose and potential uses.
14. Data Storage
The customer agrees that Fahrdienst Schönberger GmbH may store his or her personal data for business purposes.
15. Jurisdiction
For all disputes arising out of or in connection with the contract or the contractual relationship, Augsburg is agreed upon as the place of jurisdiction, provided that
a) the customer is a registered merchant under § 1 of the German Commercial Code (HGB)
(b) he is a person treated as equivalent to a registered merchant within the meaning of § 38(1) of the Code of Civil Procedure (ZPO)
(c) he has no general place of jurisdiction in Germany
(d) he has moved his domicile or habitual residence abroad after the conclusion of the contract
